Terms of Service
These terms and conditions between you and Strategic News Service LLC, a Washington limited liability company, govern your use of stratnews.com (“Website”), the SNS Global Report and Viral Economy email newsletters (“Newsletter”), and Strategic News Service contract partners including, but not limited to the FiReHQ operated by SNS Conference Corporation (“Contract Partners”). The Website, Newsletter, and Contract Partners are referred to jointly as “SNS Media”; by using the SNS Media, you accept these terms and conditions in full.
Unless otherwise stated, Strategic News Service LLC owns the intellectual property rights for all Newsletter content. Subject to the license below, all these intellectual property rights are reserved.
A subscription is for one person only.
1) Newsletters designated as “Free Newsletters” by SNS Media may be forwarded without limit.
2) Newsletters designated “Global Report,” “Special Alert,” or “Viral Economy” may be forwarded privately to a friend(s) or colleague(s) 1 time per quarter, provided subscription@stratnews.com is copied, and provided it does not result in the Newsletter’s publication or its contents in any form except as provided in this Terms of Service.
3) You may refer a friend(s) or colleague(s) for a limited, free Newsletter trial using the link provided in the Newsletters.
4) You shall not:
a) sell, rent or sub-license material from the Newsletter; or reproduce, duplicate, copy, or otherwise exploit material from Newsletters for a commercial purpose;
b) republish material from the Newsletter (including republication on another website or app) or in public except as provided in these Terms of Service;
c) use a group inbox to subscribe to the Newsletter; or
d) share Newsletters beyond the limits provided in this Terms of Service.
5) You may reproduce a reasonable excerpt from the Newsletter(s) for a blog post or other publication, provided such publication includes attribution to SNS Media and a link to stratnews.com. Such excerpt shall not exceed 10% of content in the originating Newsletter.
Violation of any of these restrictions (or any other of the Terms of Service) shall result in immediate account termination without warning and without refund. Moreover, any violation of these restrictions may further subject you to liability for violation of SNS Media’s intellectual property rights and further claims and damages.
If Strategic News Service LLC or its Contract Partners provide you with a user ID and password to enable you to access the restricted areas of this Website or other content or services, you must ensure that the user ID and password are kept confidential.
Strategic News Service, LLC reserves the right to terminate any or all of these exceptions at any time globally or on an individual user basis.
You must not use the SNS Media in any way that causes, or may cause, damage to Strategic News Service LLC, FiReHQ, SNS Media, and/or Contract Partners, or impairment of the availability or accessibility of the SNS Media; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction, and/or data harvesting) on or in relation to the SNS Media.
You must not use the SNS Media for any purposes related to marketing without Strategic News Service LLC’s express written consent.
Violation of any of these restrictions (or any other of the Terms of Service) shall result in immediate account termination without warning and without refund. Moreover, any violation of these restrictions may further subject you to liability for violation of SNS Media’s intellectual property rights and further claims and damages.
Fire-hq.com (“FiReHQ”) is a networking website (“FiReHQ Website”) intended for the use of SNS Media customers, employees, and partners.
By using FiReHQ, you agree to operate under its rules. If information or data posted on FiReHQ is marked as private, proprietary, confidential, or similar term, you will not replicate that information and/or data without written release from FiReHQ or SNS Media. All other information and data operate under Chatham House Rule. By using FiReHQ you agree that you are free to use the information received using FiReHQ, but neither the identity nor the affiliation of the FiReHQ user, nor that of any other participant, may be revealed. The user may be revealed with the expressed consent of the user given by written consent.
Additionally, you agree NOT to use the FiReHQ Website for any of the following:
1) Harassing or making defamatory, disparaging, or derogatory comments to or about other users, administrators, vendors, or other persons. This includes consistently negative postings that are deemed by SNS Media staff to prohibit fellow users from enjoying use of the tool.
2) Posting political, illegal or illicit materials and/or content.
3) Capturing email addresses or other personal information for sending unsolicited communications.
4) Intentionally uploading or transmitting any viruses, bugs or worms, spyware, or other unauthorized software to the SNS Media Website, or using the site unlawfully in an attempt to disable or harm the Website or its users.
5) Using the Website in any way other than its obvious intended purposes, or for any ethically questionable purpose.
6) Submitting content that is illegal or unlawful, or infringes on any third party’s legal rights; submitted content must not be capable of giving rise to legal action whether against you or Strategic News Service LLC, the Contract Partners, or a third party (in each case under any applicable law).
7) Submitting any user content to the Website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
Users are encouraged to be mindful of the content they post. What may be innocuous to one user may be offensive to another, and FiReHQ Administrators may at any time, and at their own sole discretion, remove content to preserve a peaceful experience for all users.
In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material, and/or audio-visual material) that you submit to this Website, for whatever purpose.
Strategic News Service LLC and its Contract Partners reserve the right to edit or remove any material submitted to the Website, or stored on Strategic News Service LLC’s and/or its Contract Partner’s servers, or hosted or published upon the Website.
Notwithstanding Strategic News Service LLC’s and its Contract Partner’s rights under these terms and conditions in relation to user content, Strategic News Service LLC and its Contract Partners does not undertake to monitor the submission of such content to, or the publication of such content on, the Website.
FiReHQ Administrators may at any time, and at their sole discretion, ban or remove any user, for any reason deemed reasonable by FiReHQ Administrators. FiReHQ Administrators may at any time, and at their own discretion, remove or edit user-generated content posted by customers, employees, and/or partners.
FiReHQ or Strategic News Service LLC may disable your user ID and password at Strategic News Service LLC’s or SNS Media’s sole discretion without notice or explanation.
Unless explicitly stated otherwise in your specific your FiReHQ post(s) or, you grant to Strategic News Service LLC and SNS Media a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and/or distribute your user content in any existing or future media. You also grant to Strategic News Service LLC the right to sub-license these rights, and the right to bring an action for infringement of these rights.
By posting any user content on the FiReHQ Website, you expressly grant, and you represent and warrant that you have all rights necessary to grant, to Strategic News Service LLC a royalty-free, sub-licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, syndicate, publicly perform, publicly display, and/or make derivative works of all such user content and your name, voice, and/or likeness as contained in your user content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Website, Newsletter, and any other product now existing or later developed by Strategic News Service LLC (and/or its successors, affiliates, and Contract Partners) including without limitation for promoting and redistributing part or all of the SNS Media (and/or derivative works thereof) in any media formats and through any media channels.
No Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, STRATEGIC NEWS SERVICE LLC, ITS CONTRACT PARTNERS, ITS SUBSIDIARIES, AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE OR CORRECT; THAT THE SNS MEDIA WILL MEET YOUR REQUIREMENTS; THAT THE SNS MEDIA WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SNS MEDIA IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SNS MEDIA IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SNS MEDIA.
STRATEGIC NEWS SERVICE LLC DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY CONTRACT PARTNERS OR ANY THIRD PARTY THROUGH THE SNS MEDIA OR ANY HYPERLINKED WEBSITE OR SERVICE, AND STRATEGIC NEWS SERVICE LLC WILL NOT BE A PARTY TO OR IN ANY WAY MONITOR ANY TRANSACTION BETWEEN YOU AND CONTRACT PARTNERS OR ANY THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.
Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STRATEGIC NEWS SERVICE LLC, OR ITS MANAGERS, MEMBERS, AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, CONTRACT PARTNERS, SUPPLIERS, OR LICENSORS (“LIMITED PARTIES”) BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM INFORMATION CONTAINED IN THE WEBSITE OR NEWSLETTER, THE GOODS OR USE OF, OR INABILITY TO USE, THE SNS MEDIA. UNDER NO CIRCUMSTANCES WILL THE LIMITED PARTIES BE RESPONSIBLE FOR ANY INVESTMENT OR FINANCIAL-RELATED DECISIONS YOU MAKE AS A RESULT OF ANY INFORMATION IN THE SNS MEDIA. FURTHERMORE, UNDER NO CIRCUMSTANCES WILL THE LIMITED PARTIES BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMITED PARTIES ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE OR ANY INFORMATION CONTAINED IN THE SNS MEDIA; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; (VII) VIOLATION OF ANY PERSON’S OR ENTITY’S INTELLECTUAL PROPERTY RIGHTS WITH RESPECT TO ANY CONTENT OR GOODS; AND/OR (VIII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL STRATEGIC NEWS SERVICE LLC, OR ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, CONTRACT PARTNERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO STRATEGIC NEWS SERVICE LLC HEREUNDER.
THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF LIMITED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
SNS MEDIA, ITS CONTRACT PARTNERS, AND/OR ANY OF THEIR OFFICERS OR EMPLOYEES SHALL NOT BE RESPONSIBLE FOR ANY LIABILITY FOR THE ACTS, FAILURES, OR OMISSIONS OF ANY THIRD-PARTY PRODUCTS OR SERVICES WHICH SNS MEDIA OR ITS CONTRACT PARTNERS, REFERRED CUSTOMERS, OR USERS OF THIS WEBSITE EVALUATE OR USE.
Those who access or use the SNS Media do so at their own volition and are entirely responsible for compliance with all applicable United States and local laws and regulations, including but not limited to export and import regulations.
Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit.
If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.
Without prejudice to Strategic News Service LLC’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Strategic News Service LLC may take such action as Strategic News Service LLC deems appropriate to deal with the breach, including suspending your access to the SNS Media, prohibiting you from accessing the SNS Media, blocking computers using your IP address from accessing the SNS Media, contacting your internet service provider to request that it block your access to the SNS Media and bringing legal proceedings against you.
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
The SNS Media may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Strategic News Service LLC and its Contracted Partners. If you access a third-party website from the SNS Media, you do so at your own risk, and you understand that this Agreement and Strategic News Service LLC’s Privacy Policy do not apply to your use of such sites. You expressly relieve Strategic News Service LLC and its Contracted Partners from any and all liability arising from your use of any third-party website, service, or content. You agree that Strategic News Service LLC shall not be responsible for any loss or damage of any sort relating to your dealings with such third parties.
Strategic News Service LLC may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of the SNS Media from the date of the publication of the revised terms and conditions on this Newsletter and/or Website. Please check this page regularly to ensure you are familiar with the current version.
Entire Agreement
These terms and conditions constitute the entire agreement between you and Strategic News Service LLC in relation to your use of the SNS Media, and supersede all previous agreements in respect of your use of the SNS Media.
Law and Jurisdiction
These terms and conditions will be governed by and construed in accordance with the laws of Washington State, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Washington State.
